1. Introduction

These Rules and Regulations specify the conditions for Website use sonarhome.ro provided by SONARHOME S.A. a joint-stock company holding its share capital paid in full in the amount of PLN 103,650, and having its registered office in Warsaw, Poland at Aleja Jana Pawła II 22, 00-133 Warszawa, entered under number 0000726040 into the Register of Entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, and assigned taxpayer’s ID № [NIP]: 1132969342, ("Company"). The Rules and Regulations also specify the rights and obligations of Website Users, as well as services provided by the Company as part of and/or through the Website.

Each User is required to read the Rules and Regulations and comply therewith.

2. Definitions 

  1. Website - the Website administered by the Company and operated at sonarhome.ro;
  2. RegulationsRules and Regulations as set forth herein;
  3. User – a person using the Website;

3. The use of the Website

  1. The Website and materials contained therein are made available by the Company free of charge. 
  2. In order to use the Website and its functionalities effectively, the User should use a device with at least 1 GHz processor and a graphics card with a minimum memory of 512 MB, Internet access, and a web browser properly set up, such as: MS Edge, Mozilla FireFox, Chrome, or Safari with Java Script and cookies enabled.
  3. The Company shall make the Website available at all times under “as is” rule, which applies to the availability of the Website and of its content as well as to its functionalities. The Company does not warrant the availability of the Website and/or any of its functionalities. The Company shall undertake all efforts to make the Website still better and to increase its functionalities.
  4. The Company reserves the right to make the whole Website or a part thereof unavailable for a specified time in order to enhance the Website and/or add new services or/or carry out maintenance works. The Company shall endeavor to make the Website unavailable upon prior notice displayed to Users on the Website.
  5. Users shall not do anything that may adversely affect the proper operation of the Website.
  6. Users shall not supply any content that is unlawful, and/or that contains curses, profanity and/or expression(s) commonly considered offensive, and/or that is prohibited by law/decency, and/or that infringes the interests of the Company and/or its partners and/or that violates customary standards and rules applicable to Internet Users.
  7. Access to the whole Website or a part thereof may be restricted to certain User by the Company in the event that hardware and/or software used by them adversely affects the functionalities of the Website, this applying in particular to hardware and/or software that restricts, impedes or disables the publication and/or display of a certain part or portion of the content on the Website.

4. Functionalities of the Website 

  1. A User may, on conditions set forth herein, use any functionality made available on or thorough the Website, specifically that for automatic property valuation. The Website functionalities may be changed over time.
  2. The automatic property valuation provides the User with the valuation of a property, based on the property data submitted by the User. The property valuation is delivered in an automated manner, based on the proprietary algorithm developed and used by the Company. The methodology and/or techniques derived from legal regulations relating to real estate valuation are set aside in the process of property valuation. The value rendered by the property valuation described herein may vary from the actual value of the valued property and/or the value of the property as set in an appraisal delivered by a property appraiser. The property valuation offered on the Website may not be deemed to be a recommendation regarding the price at which the property should be sold or offered for sale. The process of developing the property valuation does not cover any analysis or verification of the veracity of particulars of the property being valued, this specifically applying to the property condition, its area, interior layout and location. The real estate valuation shall be made solely on the basis of data provided by the User.

5. Website content

  1. The User, by using the Website, acknowledges that the content published on the Website or certain parts thereof may be subject to intellectual property rights vested in the Company, or in the Company's partner(s), or in other Users or third party/ies. 
  2. The User shall comply with legal provisions regarding the rules applicable to the use of the Website content. The User should, in particular, avoid to do anything that may violate the rights of the Company, Company's partner(s), other User(s) and/or third party/ies regarding the content published on the whole Website or in certain section(s)/part(s) thereof. It is forbidden and prohibited to copy and/or distribute the content of the Website without the Company’s prior consent, this applying specifically to content owned by the Company. 
  3. The Company may publish information on prices and/or values of real properties selected by it, as well as offers from the real estate market. The Company will not verify the veracity and/or reliability of real estate prices, valuations or offers provided on the real estate markets.
  4. Advertising materials may be published on the Website. They may be personalized and customized according to User's individual preferences revealed by his/her online activity.


6. Complaints, applications, withdrawal

  1. The User shall have the right to file a complaint regarding the operation and/or non-performance or improper performance of the Website. The complaint should report irregularity/ies found via e-mail filed to the address kontakt@sonarhome.pl. The Company shall consider the complaint and advise the User a decision resulting from such consideration within 14 (fourteen) days following the receipt of the complaint. The response to the complaint shall be sent to the email address from which the User had sent the complaint.
  2. Users' questions regarding the functionalities of the Website and answers given by the Company may be published in an anonymized format. The collection of frequently asked questions and answers (Frequently Asked Questions, FAQ) may be subject to updates.
  3. A User who in the contract executed with the Company acts in the capacity of a consumer shall have the right to withdraw therefrom within 14 days following the date of such contract. The right to withdraw may be exercised by the User acting as a consumer by sending a withdrawal notice via e-mail to: kontakt@sonarhome.pl

7. Company's responsibility and liability

The Company shall not be held liable for:

  1. third party’s acts or things,
  2. correctness, reliability and timeliness of content published on the Website,
  3. consequences of using or not being able to use content published on the Website,
  4. temporary or permanent unavailability of the Website and/or services,
  5. User’s sharing any content with third party/ies,
  6. such acts and things of a User and/or third party/ies that are beyond the Company’s responsibilities and/or control,
  7. damages resulting from the occurrence of force majeure.

8. Privacy policy and personal data

9. Miscellaneous provisions 

  1. In the event that a provision hereof is found invalid or null and void in whole or in part, the other provisions hereof shall remain in full force.
  2. Any and all matters that these Rules and Regulations and/or contracts for electronically delivered services do not provide for shall be governed by Polish laws, unless mandatory provisions of law provide that they shall be governed by a law of another jurisdiction.
  3. A court competent to consider disputes between the Company and (a) User(s) shall be a Polish court of proper jurisdiction over the seat of the Company, save where mandatory provisions of law provide that the dispute shall be lodged with a court of other jurisdiction. A User who acts as a consumer shall have a right to seek an extra-judicial settlement of the dispute by using EU ODR platform available at: https://ec.europa.eu/consumers/odr, if the Company provides its services for a fee. The ODR platform is a single point of entry for consumers and traders for the out-of-court resolution of disputes arising from an online sales or service contract. It is an interactive website which can be accessed electronically and free of charge in all the official languages of the institutions of the European Union.

  4. The Company reserves the right to amend these Rules and Regulations. Amendments hereto shall be made available to Users on the Website and they shall enter into force as of the date and time of their publication on the Website, unless the Company resolves that the amendments should enter into force after a specified grace period.

  5. Each User should make himself/herself immediately familiar with the Rules and Regulations currently in force and then monitor further amendments thereto on a current basis.
