1. Purpose of this Privacy Policy

While using the Website sonarhome.ro ("Website"), you provide us with a number of your personal data. Data about you is collected also in connection with your use of the Website's individual functionalities.

As we process your personal data, we strive to cover your privacy with adequate protection measures. In addition, we are also obliged to perform a number of obligations arising from the provisions on the protection of personal data, including, but not limited to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “GDPR”. The information obligation set forth in GDPR articles 13 and 14 is of particular importance. 

That is why we have decided to adopt this Privacy Policy, which sets the rules for the processing of your personal data and that contains a package of information about the scope of your personal data processing and of your rights related thereto.

You are requested to read the contents hereof before using the Website and to keep in mind that you may always contact us if you have any doubts and/or questions.

2. Scope and categories of personal data processed and their sources of origin

We shall process your personal data that are collected when you use the Website or that are obtained with the use of cookies and/or similar mechanisms of saving information in the devices of Website users. You also share some of your personal data with us by sending us inquiries or requests, or otherwise. We shall collect some of personal data when you use our Website, including but not limited to login data, IP addresses of devices you use, your activity on the Website and traffic generated by you to and from the Website.

The following categories of personal data may be collected, in particular: personal data (first name, surname), contact details (email address, telephone number), data on real estate(s) (real estate in which you live, which you own, etc.).

3. Personal data administrator

The administrator of your personal data shall be SONARHOME Spółka Akcyjna, a joint-stock company with its registered office in Warsaw, Aleja Jana Pawła II 22, 00-133 Warszawa, Poland (hereinafter referred to as "SONARHOME" or "Administrator"). SONARHOME also appointed a data protection officer who you may contact via email: iod@sonarhome.pl.

SONARHOME may give access to the Website to certain entities, hereinafter referred to as "Trusted Partners" (list of Trusted Partners) and allow them to place their own codes on the Website and/or to save cookies on your device(s) in order to make it possible for Trusted Partners to develop your profile, i.e. analyze your activity on the Internet, and, in particular, to display ads that may be tailored to your interests, preferences, expectations and location, by means of a  personal data automated processing system used to assess certain personal factors, specifically in order to analyze and/or forecast work effects, economic situation, health developments, personal preferences, interests, credibility, behaviour, location or movements, migrations and/or relocations (hereinafter referred to as “profiling”). In this regard, Trusted Partners shall be your personal data administrators independent of SONARHOME, and privacy policies developed and implemented by Trusted Partners shall apply to the their processing of your personal data.

4. Purposes and basis of the personal data processing

Your personal data shall be processed on the following bases in particular in order to:

1) provide content, adverts and services of the Website, including but not limited to the content tailored to your interests, preferences, expectations and location. Hence, personal data processing shall be necessary with regard to the legitimate interests pursued by the Administrator under GDPR Article 6.1(f),  i.e. running the Website and executing advertising broadcasting agreements concluded with advertisers;

2) enhance the attractiveness and functionalities of the Website. Hence personal data processing shall be necessary with regard to the legitimate interests pursued by the Administrator under GDPR Article 6.1(f), i.e. in order to disseminate the Website content and bring it into popular use;

3) develop and share databases offered on the Website, specifically in the field of real estate data. Hence, personal data processing shall be necessary with regard to the legitimate interests pursued by the Administrator under GDPR Article 6.1(f), i.e. in order to ensure the development of the Website, and to enhance the content and the scope of information to be made available on the Website;

4) perform analyses and/or statistical reports.  Hence, personal data processing shall be necessary with regard to the legitimate interests pursued by the Administrator under GDPR Article 6.1(f), i.e. in order to analyze Website users' activities, their behaviour, interests, preferences, mode of Website use and the Website functionality – all these for the purpose of enhancing the Website, its content, functionality and services rendered;

5) identify the sender and respond to complaints, in respect whereof the legal basis for personal data processing is provided by the contract the performance of which requires that personal data be processed (GDPR Article 6.1(f)) or by our legitimate interest under GDPR Article 6.1(f) consisting in the requirement to respond to a submitted complaint or plaint;

6) identify, investigate or defend against claims. Hence, personal data processing shall be necessary with regard to the legitimate interests pursued by the Administrator GDPR Article 6.1(f) i.e. protection of our rights.

Please, keep in mind that a portion of your data shall be processed for the above or other purposes also on the basis of your consent.

Your personal data may also be used in an anonymized format in order to develop statistical analyses of the behaviour, interests and preferences of Website users and their mode of the use of the Website and its functionalities.

5. Requirement to provide personal data

You may provide your personal data on a voluntary basis, but failure to do so may result in our being unable to perform the action(s) you have requested.

6. Sharing personal data

Your personal data may be shared with our external service providers and companies cooperating with us. Your personal data may be shared, in particular with companies responsible for operating our IT systems as well as hosting companies, marketing agencies (in the field of marketing services) and real estate agents. Your data may also be disclosed to competent authorities or third party/ies who submit a request for such information, based on the appropriate legal basis from which the legal obligation to provide information arises and in accordance with applicable law.

7. Personal data retention period 

We shall store your personal data for the period that may be necessary to achieve the goals for which the data was collected or as long as we do not receive your effectively delivered cancellation of consent or an objection to process or a request to delete your personal data, and thereafter your personal data shall be subject to deletion or the data shall be anonymized in such a way that it will be infeasible and impossible to determine your identity based on an anonymized data set.

In certain circumstances, your personal data may be stored for a period longer than that specified in the previous sentence, in particular where it occurs necessary to establish, investigate and/or defend against claims (if any) or where the obligation to keep your personal data on arises from the provisions of law.

8. Transfer of personal data outside the EEA

We cannot preclude that some of the entities whose services we use and with whom we may share your personal data will process the data outside the European Economic Area (EEA). However, we shall transfer your personal data only where an adequate level of protection for your personal data is established, as required by the provisions of the GDPR.

9. Rights related to the processing of personal data

Please, be advised that according to principles set forth in details in the GDPR, you may exercise, inter alia, the following rights:

1) a right to access your personal data: at your request, we shall confirm whether, or not, your personal data is being processed, and if so, we shall provide you, in particular, with the specification of the scope and purposes of your personal data being processed, the recipients thereof and the period in which your personal data may be processed;

2) a right to rectify your personal data: you shall have the right to require that incorrect personal data of yours be rectified immediately;

3) a right to require that your personal data be removed: we shall immediately remove your personal data at your request, unless further processing thereof occurs allowable under laws in force;

4) a right to put certain restrictions on the processing of your personal data: you shall have the right to request that the processing of your personal data be subject to certain restriction(s) to the extent permitted by laws;

5) a right to file an objection as to the processing of your personal data: to the extent permitted by laws you shall have the right to object to the processing of your personal data;

6) a right to transfer your personal data: to the extent that your personal data is processed in connection with the executed contract or your consent, you shall have the right to require that the personal data provided by you be delivered to you in a structured, commonly used machine-readable format. You shall also have a right to transfer the same to another administrator.

7) a  right to terminate your consent to the processing of your personal data: to the extent that the processing of your personal data is based on your consent, you shall have the right to terminate such consent at any time without infringing the right to process the personal data  on the basis of your consent before its termination;

8) a right to submit a complaint to a supervisory body: you shall have the right to lodge a complaint with a supervisory body being in Poland the President of the Office for Personal Data Protection (https://uodo.gov.pl/), while in the Romanian National Supervisory Authority for Personal Data Processing  (https://www.dataprotection.ro/).

10. Profiling of personal data

Your personal data as well as other data derived from cookies or from elsewhere may be processed in an automated manner, such as profiling or otherwise. The process of automated decision making shall consist in adapting and/or tailoring the content of the Website, including, but not limited to advertisements, to your interests, preferences, expectations and location. The personal data may also be used for marketing purposes under GDPR Article 6.1(f).

11. Cookies and the purposes of their use

Cookies constitute IT data sets and are text files stored in the device of the Website User. Cookies are intended to be used for browsing the Website pages. Cookies usually contain the name of the Website from which they originate, their storage time on the end User’s device, as well as a unique number.

Two basic types of cookies may be used by the Website: "session" cookies and "persistent" cookies. Session cookies are temporary files that shall be stored on the end User's device until the User logs out or leaves the Website or closes the web browser. Persistent cookies shall be stored on the end User's device for a time specified in the cookie parameters or until they are deleted by the User.

a) customize the content of the Website pages to the user's preferences, individual needs or requirements and/or to set the Website's functionality to the user's device,

b) create and collect statistical data in order to improve the Website’s suitability,

While using the Website, the particulars of the User’s IP address, domain name, browser type and operating system type shall be automatically collected. These data may be collected by means of cookies, Google Analytics and/or an other similar analytical systems. Data related to the use of the Website's functionalities, such as real properties preferred in searches, history of browsed real properties etc. shall also be automatically collected.

Your personal data put in cookies in connection with your use of the Website shall be stored until you exercise any of the rights listed above in Section 9 of the Privacy Policy, to the extent that the exercise of such right results in the cessation of the processing of your personal data contained in cookie files, or until the appropriate storage conditions and/or access by cookies is set in your web browser.

12. Determining the conditions for storing or accessing cookies

You may change cookie-related settings by yourself at any time, specifying the conditions for their storage and/or access by cookies to your device and/or web browser. Changes of settings mentioned in the previous sentence may be made by the User via browser settings or with the use of the service configuration. These settings may be changed in the web browser settings in such a way that, in particular,  the automatic handling of cookies is blocked or the User is prompted whenever a cookie is placed on his/her device. Detailed information on the options for and the methods of managing cookie files are available in the settings of the software and/or of the web browser.

You may also delete cookies at any time using features available in your web browser.

Restricting the use of cookies may adversely affect certain functionalities available on the Website.

Where your web browser's settings are not modified with regard to managing cookies, the cookies shall be automatically placed on your device. Where such modifications are not made, your use of the Website shall mean that you give your consent to the use of cookies on the terms and conditions set forth herein.

14. Amendments to the Privacy Policy

We reserve the right to amend the Privacy Policy or modify the Privacy Policy in order to make it compliant with laws currently in force. The Privacy Policy in its most current wording shall be available at all times in the footer of the Website.

This version of the Privacy Policy shall enter into force as at 07.11.2022.
